| Summary: | Writ to Roger Hillary to send into Chancery the record of a case in Common Pleas between the king and Archbishop Thoresby over the right to present to the prebend of Osbaldwick. Record attached, from the plea roll for Hilary term 1354, reciting previous presentations and stating that the last vacancy occurred on the death of Fargis, and that the prebend remained vacant until the temporalities of the archbishopric cane into the king's hands after the death of Archbishop Zouche, and thus the presentation pertains to the king. The archbishop disputed this, but a jury at nisi prius found for the king. |
| Language: | Latin |
| Note: | For the entry on the Common Pleas plea roll, see CP 40/376, rot 214. Fargis had died by 2 June 1347, but Zouche did not die until July 1352. Presumably part of dispute over royal and papal presentation. |
